I’m a Landlord. Do I Need An Asbestos Survey?

Whether or not a landlord needs to obtain and asbestos survey depends on the type of property being let.

 

Domestic Properties

In the case of a domestic property where there is only one tennant (or family living with that tennant) there is no need to obtain and asbestos survey.

Where a domestic property is let to multiple tennants, i.e a home of multiple occupancy, a landlord will need to obtain an asbestos survey for an communal (shared) spaces. Examples include shared kitchens, common rooms, hallways, staircases and bin stores.

 

Non-Domestic Properties

The requirements for a non-demestic property are different. When you lease (rent) a non-domestic property you will usually become responsible for the maintainence and upkeep of the building. Therefore, the duty to manage asbestos will usually become your responsibility and, as such, it will become your responsibility to keep and up-to-date asbestos register.

 

How Often Should An Asbestos Survey Be Updated?

Although the regulations in England and Wales don’t specificy how frequently an asbestos survey is updated, it is generally considered the norm to update an asbestos survey annually. The register should also be updated if any asbestos containing materials are damaged or removed.
