Asbestos Management Survey

You need to arrange an Asbestos Management Survey if you own or are responsible for a non-domestic building built prior to 2000. In such an instance, the law states that you have a Duty of Care to manage asbestos for all non-domestic premises and common parts of domestic premises which are rented. You are also required to have an asbestos management plan in place (called an asbestos register).

 

What is an Asbestos Management Survey?

An Asbestos Management Survey is a visual inspection of a property or area of works where asbestos-containing materials are likely to have been used. Asbestos testing is carried out on any exposed suspected asbestos materials, but any materials which cannot be accessed can only be presumed as containing asbestos. This type of survey was previously known as a Type 2 Asbestos Survey which is now obsolete and should be updated with an Asbestos Management Survey.

Once the results of the asbestos tests are known, they are plotted onto a written report stating the type, condition, and exact location. At the same time, a photograph of the area is taken.

Do I Need an Asbestos Report?

You will also need a management report if you are selling or leasing a commercial building and solicitors now advise their clients to have a report carried out prior to the contract being drawn up as failure to do so can cause a delay.

You may also be required to obtain a more intrusive refurbishment and demolition survey if you are having any refurbishment or demolition work carried out on any property built prior to 2000. This is to ensure that no one is put at risk of exposure to asbestos-containing materials during the works and that thorough asbestos testing is carried out during the asbestos inspection.

Any landlord of a House in Multiple Occupancy (HMO) must ensure that an asbestos survey is obtained in any areas that are shared i.e. communal areas, as the report enables those who use the areas to understand if there is any risk of exposure to asbestos. Such areas might include kitchens, common rooms and bin sheds.

 

How Common is Asbestos in Buildings?

Very. Asbestos was used in all manner of applications in building construction including moisture resistance, fire protection, heat protection, and insulation. It can be found in floor tiles, water tanks, soffits, walls, plaster, textured wall coverings (Artex), damp proofing, toilets, rainwater goods, and many other products.

Some examples of buildings which might require a management survey include (but are not limited to):

  • warehouses
  • garages and workshops
  • offices buildings
  • factories
  • educational facilities such as schools and universities
  • hospitals

Given the way in which asbestos-containing materials have been used in concealed and composite structures during the construction of the building, asbestos may only be detected during the course of subsequent demolition and a subsqient asbestos inspection. Care should be taken during the demolition of ceiling cavity walls and removal of floor slabs, incased concealed features, such as piped services and fire–resistant linings are present.
